Technical requirements for products

Introduction

The main objective of Act 22/1997 Coll. Is, above all:

 

 

In its regulations, the government specifies the:

  • Products which represent an increased threat to public interests (i.e. selected products that could endanger the health or safety of persons, property or the environment or any other public interest),
  • Technical specifications with which the said products must comply to be allowed to sell on the market;
  • Designation and marking of the said products,
  • Compliance assessment procedures (modules), which depend on the technical sophistication of the product and the extent of its potential danger.

    Manufacturer’s/importer’s obligations

    • To ensure that the products sold on the market comply with the basic requirements specified in the annex to the applicable government regulations,
    • To ensure the assessment of the compliance using the methodology specified in the applicable government regulation,
    • To label the product in the manner specified in the applicable government regulation (usually by means of the ‘CE’ label), or issue/attach to each product a document specified by the applicable government regulation;
    • To archive the product-related documentation in the manner and for the period specified in the applicable government regulation.

    Distributor’s obligations

      • To act so as to prevent the distribution of products which patently fail to comply with legal requirements, particularly products not labeled with the prescribed marking or labels
      .

    Subsequent to the accession of the Czech Republic to the EU, it has become important for Ferona that the legal regulations pertaining to the assessment of compliance apply to the entire EU market and not just to the Czech market. Similarly, products from other EU member states are no longer considered to have been imported.

    Products which comply with the aforesaid requirements have a free movement guarantee throughout the EU. The most common confirmation of the fact that the product has complied with the requirements within the

    harmonized territory is the ‘CE’ sticker placed on the product. Non-harmonized territories, Section 13b) of Act 22/1997 Coll., has applied since accession. This provision stipulates that an assessment of compliance is not required for products that have already been launched on the market elsewhere in the EU and that ensure adequate protection of public interests.

    Ferona’s compliance

    Ferona complies with the aforesaid requirements as follows:

    • Whenever Ferona acts in the capacity of a distributor, it strives to prevent the distribution of selected products which patently fail to comply with the legal requirements. With products manufactured in the Czech Republic and supplied by Czech suppliers, Ferona has free access to documents that demonstrate the assessment of compliance. With products manufactured in EU member states and sold on the EU market, Ferona knows whether the compliance has been assessed and whether the products are being legally sold in another EU member state.
    • Whenever Ferona acts in the capacity of an importer (for products from outside the EU and EFTA), Ferona either issues a proprietary certificate of compliance in accordance with the method described in the applicable government regulation, or Ferona handles documents that demonstrate that the product concerned is being legally sold in another EU member state. Ferona provides these documents only to persons specified in Act 22/1997 Coll.

To ensure that products launched on the market comply with the requirements which are essential for product safety as well as for other product characteristics deemed a matter of public concern. Selected products must therefore comply with the said technical requirements prior to their launch on the market, while compliance must be supported by an assessment of the product’s compliance with the relevant technical standards and specifications.
